Other Information:
- Referral & Investigation are charged and relate to identifying the need for Fiduciary Services. This also includes Trust Document Review, Preparation of Account Synopsis, Preparation of Account Files, CPA Review, Investment Advisor Meeting, Budget Preparation and Account Assets Transfer, etc. The Set Up fee does not include time at court for petition of the ward or hearing. The rate of service is billed separate for appearance in court for the new account.
- Accounting Fees are the fees charged to meet the statutory requirements for a Trust and Court Requirements for a Conservator.
- Annual Administration Fee contributes the minimum fee that would be charged for the year if hourly rate of service does not meet the annual minimum fee. The annual fee is only charged at the end of the year, if the hourly rate does not meet the annual minimum fee.
- Termination Fee contributes to the costs involved in closing a case due to the transfer of responsibility to a successor fiduciary, or to the ward who has recovered from legal disability or the estate no longer needing fiduciary services. Documents are prepared for closing and storage.
- Copy fees are charged to the account for Annual Accounting, Tax Preparation and any other time when an excess of copies are required for the administration of the account.
All fees are provided on the monthly billing statement for the account and are available for viewing by the Trustee, Co-Trustee, Ward or Beneficiary as requested.
If the account is subject to Bond Fees and Recording Fees, they will be paid directly from the resources of the Ward, or reimbursed to the Fiduciary, if paid prior to transfer of assets from the Ward.
All fees are subject to approval of the Superior Court, with notice of the requested fees and the hearing date given to relatives and other interested parties as required by law. Ordinarily, no fee will be taken until it has been approved by the Court. In certain instances, however, good cause exists to take a fee prior to Court approval, such as to minimize an estate’s tax liability in a given year, or to spend down the estate to qualify for governmental benefits. In these instances, if the fee taken is not subsequently approved by the court in whole or in part, then the portion not approved will be reimbursed to the estate or account.
Contract or “out-sourced” services (those services not performed by the fiduciary) provided to the client/ward for such things as accounting services, investment management, inventory, case management and bookkeeping shall be billed to the client/ward.
